The Income Tax Act has laid down very strict rules regarding what insurance premium qualifies as a business or personal expense. There is the misconception that as long as the business owns an insurance policy the entire premium is a tax write-off for the business.

Our experience has shown the following as areas where the misconception is very serious:

  • Writing-off the salary of a disabled executive/owner without prior institution of a qualified salary continuation plan,
  • Writing-off the premiums for only one disability policy or for two or more without going through the proper installation process,
  • Writing-off premiums for a corporate-owned insurance programs meant for share redemption purposes,
  • Writing-off all premiums of a 100%-paid plan for a Group Benefit Plan without noting that premiums for some benefits must be taxable to the employee.

The tax consequences of the above, when detected by the tax department during an audit, are very harsh.
